Welcome to Prospersuit. These Terms of Use ("Terms") govern your access to and use of the Prospersuit mobile application, website, and related services (collectively, the "Service"). The Service is operated by Prospersuit ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
IMPORTANT: These Terms contain an arbitration clause and class action waiver that affect your rights. Please read Section 16 carefully.

The success routines and celebrity information provided in our Service are for inspirational and educational purposes only. We do not guarantee specific results from following any routine.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROSPERSUIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE.
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify, defend, and hold harmless Prospersuit, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
While we take reasonable measures to backup and protect your data, we are not responsible for any loss or corruption of your User Content. You are responsible for maintaining your own backups. You can export your data at any time from the app settings.
You may terminate your account at any time by deleting your account through the app settings or by contacting us at support@prospersuit.com.
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.
Upon termination, we will delete your account and User Content within 30 days, except where we are required to retain it for legal purposes. Sections of these Terms that by their nature should survive termination shall survive.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability.

Before filing a claim, you agree to contact us at legal@prospersuit.com and attempt to resolve the dispute informally for at least 30 days.
If we cannot resolve the dispute informally, any dispute arising from these Terms or the Service shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules. The arbitration will take place in Los Angeles, California, or another mutually agreed location.
YOU AND PROSPERSUIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Either party may bring suit in court for injunctive relief to protect intellectual property rights or to enforce these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prospersuit regarding the Service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or failures of third-party services.
We may provide notices to you via email, in-app notifications, or by posting on our website. You consent to receive electronic communications from us.
